This conference assessed the future of the employment rights and tribunal system in England and Wales.


Delegates considered the potential implications for employment rights and the UK’s labour market following the decision to withdraw from the European Union, including potential changes and the key challenges for policymakers with the UK outside of the EU’s common employment law framework.
 
Further sessions considered the future for employment tribunal fees in light of the Government’s Post Implementation Review currently awaiting publication and the Justice Select Committee’s recent courts and tribunals fees and charges inquiry, which found that the current fees regime has had a ‘significant adverse impact’ on access to justice for meritorious claims and called for a significant reduction.
 
Sessions explored the next steps that could be taken to modernise the employment tribunal system and included discussion on the potential future use of online courts and Delegated Judicial Officers following the publication of the Senior President of Tribunals’ Annual Report 2016, which called for the modernisation of employment tribunals and to create a system which is ‘digital by default’, over the next four years.
 
The conference also offered delegates the opportunity to consider the initial impact of the introduction of mandatory Early Conciliation as well as the use of alternative forms of dispute resolution.
 
It brought together key policymakers with stakeholders including employment lawyers and legal groups, employers, trade unions, mediation professionals, academics and others with an interest in these important issues.
